The story of food hygiene and safety is not new but never old, especially on New Year holidays. According to the official report of the Ministry of Health, in the Lunar New Year 2015, up to 1500 people went to visit hospitals because of food poisoning and 5 people died. Suffering from food poisoning on New Year holidays not only severely damages our health and financial conditions but also severely affects our spirit. So when being poisoned by poor-quality food, what should consumers do first to protect their interests?
#1: What to do first when family members accidentally suffer from food poisoning?
When you or your family members suffer from food poisoning, report immediately to the nearest health authority and keep the leftovers for submission to preventive health agencies of the province, district, town, or provincial city (referred collectively to as districts). These leftovers shall be examined to find the cause of food poisoning. Accordingly, the owner of the establishment that produces poisoned food shall bear full responsibility for wrongdoing and must pay all expenses for medical examination and treatment for poisoned patients and expenses for finding out the cause of poisoning for investigating bodies.
#2: In what case shall customers be compensated when suffering from food poisoning?
When any food of any kind (packaged, branded) poisons customers, the owner of the establishment that produces that poisoned food shall bear the responsibility for compensation.
#3: Where to claim for compensation when suffering from food poisoning?
In case of suffering from food poisoning, you can go directly to the establishment that produces that poisoned food to claim for compensation. If the negotiation fails, you can sue the owner of the establishment and go to the Court to claim for compensation. When going to the Court, you must bring evidence proving that the use of the poisoned product is the cause of the poisoning and not other foods; and expenses for medical treatment. For example: the purchase invoice, the conclusion of the authority stating that the product causes food poisoning, medical records, hospital bills and other expenses for treatment.
#4: What are the conditions for being able to receive compensation for food poisoning?
The conditions for you to receive compensation include sufficient evidence proving that the use of the poisoned product is the cause of the food poisoning and not other foods, expenses for medical treatment, and a reasonable claim on the cost of compensation.
